Conditions.
These are the terms under which you may use the websites, apps, games, and services offered by NeonArc Studio. By using anything we make, you agree to what's written here. If you don't agree, please don't use the things — we won't be offended.
◇ 01 / Quick definitions
- "We", "us"
- NeonArc Studio, an independent software studio based in Wrocław, Poland.
- "You"
- Anyone who installs, opens, signs into, or otherwise interacts with our products. If you're using these on behalf of a company, "you" means the company.
- "Services"
- Our website (
neonarcstudio.pl), LinguiSpark (Android language-learning app), Clear Skies (Android game, in development), and any other product we release under the NeonArc Studio name in the future. - "Content"
- Text, audio, images, or other data that flows through the services — whether created by us or by you.
02 / Eligibility & your account
You must be at least 13 years old to use our services. If you are under 13, please do not install or use our apps.
Some services — including LinguiSpark — can be used as a guest without an account. Your progress in guest mode is stored only on your device. Creating an account lets you back up and sync your data across devices.
When you create an account, you agree to provide accurate information and to keep your password to yourself. You are responsible for all activity that takes place on your account. If you suspect someone else has accessed your account, email us at support@neonarcstudio.pl and we will help you secure it.
You can delete your account at any time from within the app (Settings → Account → Delete account) or by emailing support@neonarcstudio.pl. Account deletion permanently removes your cloud-synced data.
03 / What you can do
Subject to these terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to use the services for your own non-commercial use. You can:
- Install and use our apps and games on Android devices you personally own or control.
- Stream, screenshot, or record gameplay of our games and share it on any platform (you keep the copyright in your own footage; please credit the game title and "NeonArc Studio").
- Use LinguiSpark for as long as your account is active; the app supports use across multiple Android devices signed into the same account.
04 / What you can't
We trust you, but we have to write this part anyway. You agree not to:
- Reverse-engineer, decompile, or modify the services, except as specifically allowed by EU or Polish law.
- Use our services to harass other users, distribute malware, or break the law in your jurisdiction.
- Scrape our content, run automated bots against our servers, or otherwise behave in ways that disrupt other users.
- Resell, sublicense, or rebrand our services without a written agreement signed by us.
- Use our trademarks ("NeonArc Studio", "LinguiSpark", "Clear Skies", the arc mark) in ways that suggest we endorse you when we don't.
05 / Subscriptions, payments & refunds
LinguiSpark may offer optional paid subscriptions or one-time purchases. All payments are processed by Google through Google Play. We do not directly process or store your payment information.
Subscriptions renew automatically until you cancel them through your Google Play account settings. Cancellation takes effect at the end of the current billing period.
Refunds for purchases made through Google Play are governed by Google Play's refund policies. In EEA countries including Poland, Google Play provides specific refund and withdrawal-rights processes under applicable EU and Polish consumer law — see Section 10 below and the Google Play EEA refund page for details. We do not handle refunds directly; all refund requests for Google Play purchases must be submitted to Google.
If we change the price of an active subscription, we will notify you by email at least 30 days before the change takes effect. You may cancel at any time.
06 / Pre-release software
Pre-release means unfinished
From time to time we may offer access to software in alpha, beta, or early-access form. Pre-release software is unfinished. It may have bugs, cause unexpected behaviour, or change significantly before the final release. By participating in any NeonArc Studio pre-release programme you accept these risks. This does not affect any mandatory statutory rights you hold under Polish or EU consumer law.
07 / Content you create
Inside our services you may produce content — notes, tags, custom preferences, or other data you enter. You keep full ownership of everything you create. You grant us a non-exclusive, royalty-free licence to store, transmit, and display that content solely as necessary to operate the service for you. We will not use your content for any other purpose without your explicit consent.
If we ever want to use anonymised aggregate insights from user data for product research, we will seek your opt-in consent and allow you to withdraw it at any time.
08 / Our intellectual property
Everything we produce — our code, design, brand, product names, artwork, in-app curricula and content, and any future products we announce — belongs to NeonArc Studio or our licensors. These terms do not transfer any of that ownership to you. All rights not expressly granted here are reserved.
09 / Warranty & liability
We do our best, but we provide the services "as is" and "as available". To the maximum extent permitted by Polish and EU law, we disclaim implied warranties of merchantability and fitness for a particular purpose. Our total liability to you for any claim arising out of the services is capped at the greater of (a) EUR 50 or (b) the total amount you have paid us in the 12 months before the claim arose.
Nothing in these terms limits our liability for death, personal injury caused by our negligence, fraud, or any other matter that cannot be limited or excluded under applicable law. Nothing in these terms affects any mandatory statutory consumer rights you hold under Polish or EU law — see Section 10.
10 / Consumer rights (EU & Poland)
If you are a consumer resident in a European Union member state (including Poland), you have statutory rights that these terms cannot remove or restrict. Key points:
- Conformity of digital content (Directive 2019/770 / Polish Consumer Rights Act as amended from 1 January 2023). Digital content and services we supply must conform to the contract. If content is defective or non-conforming, you have the right to have it remedied, and in some cases to a price reduction or to withdraw from the contract.
- Right of withdrawal for paid digital content. Under the EU Consumer Rights Directive and Polish law, you generally have a 14-day statutory withdrawal right for distance purchases. For digital content (such as a paid app or in-app content) that you access immediately, you may be asked to acknowledge that you waive the automatic withdrawal right when the download or access begins — this is handled by Google Play at the point of purchase, not by us. If you have not yet accessed the content, the 14-day withdrawal right remains available. For digital services (such as a recurring subscription), a 14-day withdrawal right applies from the date of purchase; after that, cancellation takes effect at the end of the billing period.
- Refund routing. All in-app purchases go through Google Play. Your statutory withdrawal and refund rights against Google as the distributor are set out on the Google Play EEA refund page. Statutory rights against us as the developer remain unaffected.
- Non-waivable rights. Nothing in these terms, and nothing in our disclaimers or liability caps, operates to waive or limit any right you have under mandatory Polish or EU consumer protection law that cannot lawfully be contracted away. If any clause conflicts with such a mandatory right, the mandatory right prevails.
11 / Termination
You can stop using the services at any time. You can delete your LinguiSpark account from within the app (Settings → Account → Delete account) or by emailing support@neonarcstudio.pl.
We may suspend or terminate accounts that violate these terms. We will email you before doing so unless the violation involves immediate harm to other users (for example, ongoing abuse). If we terminate your account without cause while you hold an active paid subscription, we will request a refund of the unused portion from Google Play on your behalf, since all payments are processed by Google (see Section 05); your statutory consumer rights under Section 10 are unaffected.
12 / Governing law
These terms are governed by Polish law. Any dispute will first be attempted to be resolved by writing to us at support@neonarcstudio.pl. If that fails, the matter falls under the exclusive jurisdiction of the courts of Wrocław, Poland, except where mandatory consumer-protection law gives you the right to bring a claim in your own country of residence.
If you are a consumer in an EU member state, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
13 / Changes to these terms
We may update these terms when meaningful changes are made — for example, when new features such as cloud sync, subscriptions, or additional products are introduced. When we do, we will bump the version number, update the effective date at the top of this page, and notify users with active accounts by email where we hold an email address. We will not make changes retroactive. Continued use of the services after the new terms take effect constitutes acceptance of the updated terms.
